TOLATA Claims
The Trusts of Land and Appointment of Trustees Act 1996 (TOLATA) is used by the court to determine ownership of a property or land when there is a beneficial interest in a property.
TOLATA is mostly used for disputes between unmarried, cohabiting couples who live together in a property under sole or joint ownership (either as joint tenants or tenants-in-common).
TOLATA Claims usually arise where one occupant lives in the house but does not own the house but contributes to the upkeep of the property. If they have regularly contributed to the maintenance of the property they might be entitled to a share of it.
If you have a beneficial interest in the property and believe that you have been treated unfairly or have not been remunerated for your contributions you may be able to make a TOLATA Claim.
Most TOLATA Claims can usually be settled through dispute resolution to reach a mutually beneficial agreement without needing to go to court, thus saving both parties undue stress, time and additional costs.
