Family Law is not just about divorce and separation. It encompasses a broad range of legal issues which can arise throughout a relationship. Seeking legal advice at key stages can help avoid conflict, clarify expectations and protect financial interests.
Cohabitation or Living Together Agreements
For couples living together without marrying, cohabitation or living together agreements are an important tool which can set out how property, finances and other responsibilities will be managed during the relationship and in the event it ends. They are particularly helpful where one person contributes more financially and will help avoid misunderstandings and potential disputes later. There is a common myth that cohabiting couples become ‘common law’ spouses after a period of time, but this is not correct. We are often instructed when unmarried couples have separated. Whilst there is a cost associated with drawing up a cohabitation agreement, by providing certainty, it can save a great deal in costs if the relationship does break down in the future.
Pre & Post Nuptial Agreements
Before marriage, many couples now put a prenuptial agreement in place to set out how finances would be dealt with if the marriage ended. Whilst often associated with high-net-worth individuals, they can be useful for anyone, particularly those who have been married previously, or where one party is bringing assets into the marriage or looking to protect their children’s inheritance. It is also possible to have a post-nuptial agreement after parties have married. This can sometimes be useful where gifting of wealth is being contemplated between generations to provide reassurance to the giftee that wealth will remain within their family.

Dispute Resolution
One of the most effective tools available to separating couples is dispute resolution. There are many forms this can take, including mediation and collaborative law, which offer a chance to reach practical outcomes without the cost, stress and delay of court proceedings. These approaches can help preserve communication and lay the groundwork for future co-parenting where children are involved.
Sometimes, dispute resolution will not be appropriate, particularly if there is a significant imbalance of power or if one party is unwilling to be fair. In such cases, taking legal advice can be essential to protect your position. Orders can be obtained where necessary to freeze assets and for interim maintenance where appropriate.
