Rogue Attorneys

A recent case heard in Woolwich Crown Court reported that Mr McErlene, who claimed to be a Will writer, forged his neighbour’s signature on a Lasting Power of Attorney (LPA) in order to gain control of his finances.

Mr McErlene, as attorney under the fraudulent LPA, used his power to sell Mr Manwell’s house, purchase expensive jewellery and cash in a substantial Santander bond before he was arrested for dishonestly obtaining an LPA for personal gain, and jailed for five years.

An LPA for Property and Financial Affairs gives your chosen attorneys substantial powers to deal with your assets – as exploited by Mr McErlene, who used his power for personal financial gain. Whilst Mr McErlene was punished for his actions, this case highlights the importance of appointing attorneys whom you trust; whether this be your spouse, children, a friend or a professional.
