Work undertaken recently includes:
- Advising upon succession rights and implications of Agricultural Holdings Act tenancies (AHA tenancies) and the inheritance tax issues involved to include those faced by family farming partnerships and farming companies in order to maximise the tax reliefs available.
- Preparing transfers of farm cottages to the children of landowners as part of their long term tax planning strategy. Ensuring each transfer incorporated terms setting out the rights and responsibilities of both the child and landowner (which will be particularly important if the properties ever leave the family).
- Considering existing tenancy and leasehold arrangements in a mixed farming business and implementing an appropriate strategy to minimise the potential inheritance tax liability by re-arranging these.
